Web Knowledge Xpo Terms of Service
(Application of Terms)
Art.1 This Terms of Services (including the associated guideline and other regulations, hereinafter called “this Terms”) is applied for portal site “Web Knowledge Xpo” (hereinafter called WKX)and every kind service contents provided by Non profit organization Japan Engineers Federation(hereinafter called JEF) (these are totally called “this Service”)
2 All persons who use this service (hereinafter called “User” is the individuals and legal persons who applied for account registration through the designated procedure and JEF approved its registration.
3 All Users are regarded to have agreed to the content of this Terms of Service when they applies for registration.
4 All Users can use the service within the scope allowed by this Terms and the relevant laws.
(Modifications of Terms)
Art.2 JEF can modify this Terms without prior approval to Users.
2 When the above mentioned modification is effected, the conditions of use of this Service shall be as per the Terms after the said modification.
3 The Terms after modification shall be effective after the time when the notice notification or transmission activities according to Art.23 (notice or announcement) are
validated.
(Facility of use and method of access etc)
Art 3 Users are regarded to prepare all user side facility such as communication device. software, public line necessary for this service(hereinafter called “user side facility”) with own expense.
2 Users shall maintain their user side facility in good condition under their own responsibility so as to avoid hindrance to using this service.
3 Users shall control their own ID or password to prevent from being known by others and those shall not be lent or transferred to the third party. All damage due to using their ID or password by others shall be owed by Users.
4 Users shall comply all procedure, format, indication method, operating hour etc which are decided, specified or revised by JEF.
5 The numbers of contents which can be deposited or contributed by User are not limited by JEF, but the right to limit the numbers are retained by JEF.
(Security)
Art. 4 JEF provides the proper means to protect WKX from being accessed unfairly by firewall and virus detecting system access. Further, JEF takes proper activity to retain safety of data transmission by data encryption. JEF will try to protect the personal data
from unfair access, leakage and alteration of data through the above means and activities.
2 Users shall recognize that the absolute safety in Internet is not possible and shall consent in advance to that the personal data may not be guaranteed to be protected perfectly in communication with JEF in this service.
(Personal data)
Art 5 JEF will obtain the personal data of Users after providing necessary protective means and use for the purposes mentioned in 3 of this article.
2 The personal data means the following data which are submitted at time of registration.
1) Registration data such as name, company , address, telephone number, e-mail address
2) History of user’s demand of document
3) The purpose of use of personal data is as follows;
(1) To proceed smoothly with provision of service
(2) To inform or provide to Users the information of proprietary products, service and other sales which JEF judged proper by various communication means
(3) To respond properly to the opinions, requests, inquiry etc. from Users
(4) Users shall report to JEF immediately after modification of User’s data by the method which is separately designated by JEF.
(Information provided for Users)
Art. 6 In interpretation of information provided to Users through this service, the accuracy, creditability and reliability of information shall be judged by responsibility of Users.
2 Users shall use the information contributed by Users and information exchanged between Users considering that the information includes personal subjective assessment, change in lapse of time, hearsay information. JEF will not guarantee its integrity, accuracy, safety etc. Therefore, JEF will not be liable for any damage to the third party incurred by information obtained by Users.
(Advertisement and invitation)
Art. 7 JEF provides along with provision of this service the advertisement and invitation of the third party by the method JEF selected in a way of indicated in Web page etc.
The advertisement etc is inseparably combined with service and it will not terminate before Users terminates use of its service or JEF modifies the service.
(Collection of User’s information)
Art 8 JEF may obtain User’s personal information or cookie from Users or the third party in relation with this service.
(Fare of use)
Art 9 JEF does not decide the fare of use of this service at present time, but we retain the right to decide or revise the fare of use of this service in future.
2 The decision and revision of fare of use of this service will be informed from JEF in one sided way.
3 The user who deposit the technical animation to Web must ask for the charged service of request from viewer and guide to URL linkage at the same time of deposit of animation.
However, the charged service of document demand and linkage to URL has not been set
until now, no fare will be generated for the time being.
When JEF starts charging the fare, it will be announced by the way as specified in Art 23 indicating the date of becoming effective.
(Contents deposited by Users)
Art 10 All contents deposited or contributed to this service by Users will not be confidential and treated as contents the property right of which is not retained. Therefore, it may be disclosed worldwide, viewed, printed and utilized by other methods.
2 JEF will permit with no limit of time, with free charge and non-exclusively to use(including duplication, playing, public transmission, dictation, exhibition, sound, sentence, picture, e-mail messages, uploaded web contents , software and others which Users deposited, indicated, transferred
3 Users shall have a duty to secure the fair intellectual property of their own deposited contents
4 Users shall have a duty to deposit to WKX or contribute to JEF only contents which perfectly follow the purpose of this service, and at same time guarantee non violation of other’s intellectual property.
5 When the contents deposited by User includes the information or contents of third party,
User shall obtain the permission of use from the third party and execute proper
treatment of the related data so that JEF and the third party who JEF assigns may not be hindered.
6 Users shall not demand and execute the copyright of data which are published by JEF and others nominated by JEF.
7 JEF permits that all information contributed to JEF will be used for marketing and other purpose. Users permit that JEF will not be responsible for any contents, products /service which are reviewed on this Web service.
(Contribution of data)
Art. 11 Users shall supply pamphlet, sample or similar things within rational and proper period when any third party demands information on the information on WKX which was deposited or contributed.
(Linkage)
Art 12 When Users provide linkage to WKX with other web site, linkage shall be made on URL provided for contents which User himself registered or on top page of WKX(http://WKX21c.org)
2 When JEF finds that linkage between User and WKX is improper, JEF may demand the deletion of linkage. In this case , User is requested to follow the instruction of JEF.
(Counteraction to unfair Users)
Art 13 JEF recognize the following activities as “extreme dishonest use” and may delete the registration without prior notice and send “caution mail” to user who contacted this service. Further, JEF may make “extreme dishonest user” public through the stipulated procedure. “Extreme dishonest use” means all activities which give monetary damage to other users or fear of against law or crime. JEF will not owe any responsibility of compensation to loss of the said user, which JEF can judge and decide independently against following activities.
1. Activity violating or having fear of violating the third party’s intellectual property such as copyright, trademark right, patent right, patent for a new practical devices, right for design
2. Activity disturbing or having fear of disturbing the corporate strategies or agent activity(including brand establishment and market formulation) by violation of brand or unfair trade of import and export
3. Activity violating or having fear of violating JEF’s and the third party’s estate, privacy , personal right or portrait right
4. Activity discriminating or having fear of abusing and insulting the third party’s honor or trust causing disturbing the activity of the third party.
5. Activity giving or having fear of annoyance and damage to users due to trouble in trade or accounting
6. Activity carrying data of obscene, child pornography, or child abusing
7. Activity carrying data of exposing or describing genital
8. Activity carrying data of cruel picture of human murder, corpse and data of abusing animals and data giving dislike from social common sense.
9. Activity inviting people to suicide
10. Activity carrying data inviting people to crime by composing illegal information
11. Activity inviting or inducing illegal gambling
12. Activity conducting criminal or illegal action other than the above mentioned activity
and activity advising or assisting the third party’s criminal and illegal action
13. Activity carrying data of pyramid investment scheme, pyramid selling or similar
14. Activity sending mail or message of advertisement which is hated or having fear of hatred to third party without getting permission of JEF
15. Activity collecting or carrying the third party’ s information
16. Activity revising or deleting data which is usable in this service and JEF is going to provide for user.
17. Activity using this service by disguising
18. Activity carrying computer program harmful due to virus
19. Activity giving or having fear of giving trouble to use and operation of facility owned or controlled by JEF or the third party.
20. Activity of advertisement or invitation which is judged to be excessive or improper
by JEF
21.Other than the above, activity against law, activity contravening public policy, activity disturbing the third party’, s right
22. Activity referring data which were carried in this service.
23. Other than the above, activity against this service
24. Activity escalating assisting the above mentioned activity recognizing that it will corresponding to any of the above.
25. Other than the above, activities which JEF judged improper.
※ Illegal information includes following eight type criminal activities
(1) indecent exposure stimulant drug, drug
(2) exposure of child pornography
(3) invitation of prostitution
(4) prohibited invitation on online dating site
(5) execution of drug-related crime and publicly stirring abuse of the prohibited drug (stimulant drug, drug, psychotropic, hemp, opium, poppy)
(6) Advertisement of prohibited drug
(7) Induction of transfer of bankbook
(8) Induction of transfer of mobile phone without permission
2 JEF has the right to compulsorily withdraw the users who had executed the above activity. Those who have been withdrawn due to the above reasons will not be allowed to resume the service again.
(Public countermeasures at time of illegal use)
Art.14 JEF can suspend this service when user’s activity corresponds to any item of the above crime or illegal activity.
2 The above mentioned action will be applied even the prohibited activity is generated for service contents in this service. In this case, JEF may take action not only for activity recognized with the prohibited reason, but also for the service which is not recognized with prohibited reason.
3 When JEF recognized any activity which is to be applied with above mentioned activity，
JEF can take the following counter measures based on law or the proper declaration by the third party in addition to the countermeasures mentioned above clause 1.
(1) Prohibition of transmission of data and other information and contents of the corresponding user.
(2) Submission of use history, payment history, registration information of user, transmission data to police , other regulating agency, court, counsel association
(Import and export regulation)
Art 15 User is not allowed to contribute contents which are illegal against law of import and export, and national security, and related with contents having possibility of spy activity. Further, food and medicine which has fear of violating national laws (quality and indication etc), items under export control regulation, international contract like Washington treaty shall be confirmed and corrected in details by user.
When JEF judges that it is violating the law, JEF may reject or delete it.
(Cooperation by users and notification)
Art.16 Users shall cooperate for the rational requests from JEF. Further, when user knows violation of regulations or unauthorized or improper use, user shall inform JEF immediately when those activities are recognized.
(Acting registration)
Art.17 When JEF registers on behalf of company or institution, JEF will not be responsible for any information contributed by the company and institution.
2 JEF will not give any guarantee for commercial value, application for specified purpose,
accuracy, integrity, access ability.
(Relationship among user, other user and advertisement provider)
Art. 18 User can communicate or transact with other users under his own responsibility for occasion of use of service or advertisement. JEF will not concern and owe any responsibility regarding contact between user and the third party.
(Immunity)
Art. 19 JEF will not be responsible for loss suffered by user in relation with this service or this terms of service
2 Users shall not demand any compensation of loss to JEF and related institution, management and contractor for request, claim, damage, responsibility, various expense, counsel fee etc. caused through use of this service, on-line activity, violation of terms and transaction with the third party through this service.
(Withdrawal)
Art 20. User can withdraw and terminate this service by the option of user in accordance with procedure stipulated by JEF.
(Interruption of Service)
Art 21.JEF can temporarily suspend this service in case corresponding to the item below without prior notice to User.
(1) Maintenance or works are executed for facility used for this service
(2) When trouble or failure occurred in the facility.
(3) The use of electrical communication service became impossible due to failure of electrical communication company.
(4) Due to unavoidable reason, the temporary suspension of this service became necessary due to unavoidable reason.
(Termination of service)
Art 22 JEF can terminate a portion or all of this service with prior notice with reasonable period in advance. However, this will not be complied in case unavoidable reason is recognized.
(Notice and Information from JEF)
Art 23 The notice and information from JEF will be transmitted through indication on Web site or e-mail and by their method JEF thinks proper.
2 When a notice and information was transmitted in the method mentioned above, those will be effective from time of transmission or indication
(Right duty, prohibition of transfer of position on contract)
Art 24 User is not allowed to transfer, lent or supply of security in relation with right duty or position of user to the third party without prior approval of JEF..
(Claim of compensation of damage)
Art 25 JEF can claim the compensation of damage to user (within the rational scope, counsel fee is included) when user violates this terns of service and damage was brought to JEF. User shall respond immediately to the
(Transfer of credit)
Art 26 When any delay of collection of credit is brought, JEF can transfer the credit to the third party nominated by JEF without prior consent.
(Conformity)
Art 27 This terns of service shall comply the laws effective in Japan.
(Exclusive agreement control)
Art 28 User shall agree to nominate Tokyo summary court or Tokyo district court for mediation or exclusive control court of first trial for dispute on use of this service or this terms of service depending on amount or nature of dispute.
(Priority of Terms of service in Japanese language)
Art 29 There exist Japanese version and English version of this terms of service, Japanese version has priority due to minor difference.
